Judicial Oversight in the Comparative Context: Biodiversity Protection in the United States, Australia, and Canada
How effective are courts as policymaking institutions?
Generally speaking, courts play a far larger role
in American biodiversity law than they do in comparable
Australian and Canadian statutory programs. As
a result, studying endangered species protection offers
a useful way to identify and isolate the policy impacts
of judicial intervention. In the two cases I examine,
the American system functioned at least as well as,
and sometimes better than, the biodiversity programs
in Australia and Canada. Contrary to most scholarship
on the topic, lawsuits did not appear to slow the
American policymaking process significantly; rather,
litigation helped enforce important legal provisions
and forced government officials to address critical
shortcomings in their regulatory actions. At least in
these cases, then, litigation acted as a productive and

Influence of Gender Appropriateness of Sex-Role and Occupational Preferences on Evaluations of a Competent Person
Previous research has found that while masculine sex-role preferences are more highly valued, persons holding gender consistent sex-role preferences generally are rated as more attractive. The present study explores the interactive effect of gender consistent/inconsistent sex-role preferences and congruent/incongruent occupational choices on evaluations of a person from varying perspectives. Statistical analysis of the data revealed (1) people holding masculine sex-role preferences are perceived to have a higher motivation to succeed, and to be more competent; (2)from the perspective of friend and potential employee, persons holding gender consistent sex-role preferences are perceived as more attractive; (3) from the perspective of potential employer, there is a tendency for males to prefer employees who hold masculine sex-role preferences, while females continue to prefer gender consistent sex-role preferences
Role of a highly conserved region of the NF-kappaB essential modulator in its scaffolding function
Scaffold proteins facilitate many aspects of intracellular signaling. These proteins can regulate two or more proteins in the same pathway, or coordinate signaling from multiple pathways. Scaffold proteins are therefore key control points for the flux of signaling and play essential roles in biological systems. There are four possible mechanisms by which scaffold proteins achieve activation and propagate signaling: 1) rigid protein binding between two or more proteins to co-localize binding partners, 2) ligand-induced activation such as may result from a conformational change, 3) disorder-to-order transition where the scaffold protein folds as a result of a protein-protein interaction, and 4) dynamic processes such as phosphorylation. The scaffold protein NF-κB essential modulator (NEMO) functions via ligand-induced activation and serves as the key control point for canonical NF-κB signaling. The work described in this thesis investigates the role of a previously uncharacterized domain within NEMO that is required for function, which we term the Intervening Domain (IVD). Bioinformatic analysis reveals a high level of sequence conservation across species within this domain. Conformational changes following ligand binding are observed for NEMO and these changes require conserved sequences in the IVD. Additionally, a functional IVD is shown to increase the binding affinity of NEMO for IKKβ, enhance the thermal stability of NEMO, and is required to propagate NF-κB signaling in cells. A fluorescence-based assay is also developed to characterize the formation of a complex composed of NEMO, a zinc ion, and IκBα. A separate fluorescence-based assay is developed to measure IKK activity and is used to determine that NEMO alone or in the presence of linear tetraubiquitin does not enhance the rate of IKKβ phosphorylation of an IκBα-derived peptide. Furthermore, a number of organic small molecules and macrocycles are screened against the NEMO-IKKβ interaction. One small molecule was validated as an inhibitor and its biophysical properties and inhibition kinetics are described in this thesis. These analyses represent the first characterization of a highly conserved domain required for the function of the key control point in NF-κB signaling. Peak positions of strongly unimodal sequences
We study combinatorial and asymptotic properties of the rank of strongly
unimodal sequences. We find a generating function for the rank enumeration
function, and give a new combinatorial interpretation of the ospt-function
introduced by Andrews, Chan, and Kim. We conjecture that the enumeration
function for the number of unimodal sequences of a fixed size and varying rank
is log-concave, and prove an asymptotic result in support of this conjecture.
Finally, we determine the asymptotic behavior of the rank for strongly unimodal
sequences, and prove that its values (when appropriately renormalized) are
normally distributed with mean zero in the asymptotic limit
Study of the ammonia ice cloud layer in the north tropical zone of Jupiter from the infrared interferometric experiment on Voyager
An average of 51 Voyager 1 IRIS spectra of Jupiter's North Tropical Zone was analyzed to infer the abundance, vertical extent, and size distribution of the particles making up the ammonia cloud in this region. It is assumed that the cloud base coincides with the level at which 100% saturation of ammonia vapor occurs. The vertical distribution of particulates above this level is determined by assuming a constant total ammonia mixing ratio and adjusting the two phases so that the vapor is saturated throughout the cloud. A constant scaling factor then adjusts the base number density. A radiative transfer program is used that includes the effects of absorption and emission of all relevant gases as well as anisotropic scattering by cloud particles. Mie scattering from a gaussian particle size distribution is assumed. The vertical thermal structure is inferred from a temperature retrieval program that utilizes the collision induced S(0) and S(1) molecular hydrogen lines between 300 and 700.cm, and the 1304.cm methane band
Constitute: The world’s constitutions to read, search, and compare
Constitutional design and redesign is constant. Over the last 200 years, countries have replaced their constitutions an average of every 19 years and some have amended them almost yearly. A basic problem in the drafting of these documents is the search and analysis of model text deployed in other jurisdictions. Traditionally, this process has been ad hoc and the results suboptimal. As a result, drafters generally lack systematic information about the institutional options and choices available to them. In order to address this informational need, the investigators developed a web application, Constitute [online at http://www.constituteproject.org], with the use of semantic technologies. Constitute provides searchable access to the world’s constitutions using the conceptualization, texts, and data developed by the Comparative Constitutions Project. An OWL ontology represents 330 ‘‘topics’’ – e.g. right to health – with which the investigators have tagged relevant provisions of nearly all constitutions in force as of September of 2013. The tagged texts were then converted to an RDF representation using R2RML mappings and Capsenta’s Ultrawrap. The portal implements semantic search features to allow constitutional drafters to read, search, and compare the world’s constitutions. This paper, presenting an annotated list of 203 species of Ascomycetes and Basidiomycetes of Minnesota, is the first published report of the occurrence of many of the species in the state. The collections on which the list is based were made in five Minnesota counties and are deposited in the senior author\u27s herbarium at Faribault, Minnesota, and in the University of Michigan Herbarium at Ann Arbor, Michigan
Experience-Based Teaching Methods in Legal Counseling
Lawyers spend more time in their offices, in person-to-person encounters counseling troubled individuals, than in any other single area. The alternative to this is litigation, an expensive, inefficient, disfunctional process. Lawyers are counselors, in the most Sartrean sense of the word; whether they intend to be or not. Legal educators like Harrop Freeman and Andrew S. Watson, and legal psychologists such as Robert S. Redmount, have pointed out the inevitability of legal counseling in practice, and the lack of adequate preparation we give our students for their lives as counselors
